These terms govern the use of flatwatch.app and the services described on it. Please read the second and third sections in particular — they say what this service is, and what it is not.

Who you are contracting with

What FlatWatch does

We read documents about your building, check them against the duties Austrian condominium law places on a property manager, and keep a dated record of what was asked for and what arrived. On your instruction, and in your name, we write to your Hausverwaltung to request documents you are entitled to, and we follow up.

What FlatWatch is not

We are not lawyers and we do not give legal advice. We do not represent you before a court or authority, and we do not draft court submissions. If you need a legal opinion, consult a lawyer — our records are meant to make that cheaper and faster.

We are not your Hausverwaltung and we do not manage your building. Decisions about your building remain with you and the other owners.

The free cost check

The cost check compares the figures you enter against a published average for rented dwellings in Austria. It is a rough marker, not an audit, not a valuation, and not a statement about whether your costs are lawful or reasonable. We do not warrant that it is accurate for your building.

Prices and payment

The owner review costs €79, once, [including / excluding] VAT. If your building takes out a subscription within six months, we refund it in full.

The building subscription costs €4.90 per flat per month, with a minimum of €89 and a maximum of €249 per month, [including / excluding] VAT. It is billed [monthly, in advance] and can be cancelled with [one month's] notice to the end of a [month].

Payment is due [within 14 days of invoice].

Your right to withdraw

If you are a consumer, you may withdraw from a contract concluded at a distance within 14 days, without giving a reason. The period starts on the day the contract is concluded. To withdraw, write to support@flatwatch.app — a clear statement is enough.

If you ask us to begin before those 14 days are up, you may do so. If you then withdraw, you pay a proportionate amount for the work already done. Once the service has been performed in full, the right to withdraw ends. We will ask you to confirm both of these in writing before we start, as the law requires.

What you confirm when you send us documents

That you are entitled to share them with us, and that they are the documents they appear to be. We rely on what you send: if it is incomplete, our findings will be too.

What we promise, and what we do not

We work carefully and to a professional standard. We do not promise that a review will find anything, that money will be recovered, or that your Hausverwaltung will respond. Any timescales we give are estimates.

Liability

We are liable without limit for intent and gross negligence, and for damage to life, body or health. For slight negligence our liability is limited to damage that is foreseeable and typical for this kind of contract. Mandatory rights you have as a consumer under Austrian law are not affected by anything in these terms.

Availability

We may take the site down for maintenance, and we may change or discontinue the free cost check. We will give subscribers reasonable notice of changes that affect a paid service.

Changes to these terms

We may update these terms. Subscribers will be told of material changes at least [one month] in advance, and may cancel if they do not accept them.

Law and jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of the protection of mandatory rules in your country of residence, and you may only be sued in the courts of the district where you live, are employed or are domiciled (§ 14 KSchG).
